On 24th December, 2014 National Green Tribunal's Principal Bench headed by Justice Swatanter Kumar, in the matter related to Kanhar Dam, ordered the State of U.P. to refrain from any construction activity or felling of trees if the do not have and Environment Clearance and Forest Clearance as per law. Our main contention was the project requires a fresh appraisal under EIA Notification, 2006 and Forest (Conservation) Act, 1980 as the construction of the dam was in abeyance since last 25 years when the state govt suddenly started construction work at the river bed on 5th December, 2014. We filed another application in NGT on 7th January, 2015 as the construction work did not stop which we claimed is violation of a court order. The matter was listed yesterday 13th January, 2015 and was heard by the court. The Hon'ble Tribunal issued Notices to State of U.P. and MOEFCC and asked to reply within 10 days. The matter is now listed on 29th January, 2015.
